Violations: USPAP SR 1-1(b)(c), 1-4, 1-5, 2-1 Respondent violated the Uniform Standards of Professional Appraisal Practice ("USPAP"), Standards Rule 1-1, by failing to be aware of, understand and correctly employ those recognized methods and techniques that are necessary to produce credible appraisals for six different properties in that he made numerous errors and omissions, namely that: Respondent failed to disclose the complete listing history of a subject property (USPAP 1-5, 2-1); omitted zoning information (USPAP SR 1-1); misstated room counts (USPAP SR 1-1); failed to address depreciation (USPAP SR 1-1); incorrectly reported the subject propertys' neighborhood boundaries (USPAP SR 1-1), misstated descriptions of the subject property and Comps, misstated the GLA, style and construction of Comps (USPAP SR 1-1) thereby rendering misleading reports in violation of USPAP SR 2-1.

Chicago:

Respondent was reprimanded and assessed a $1,500 fine for preparing four appraisals in a careless and negligent manner. (USPAP SR 1-1 (b)) in that he: misstated the age of the subject property; failed to disclose a previous listing (USPAP SR 1-5); failed to state and analyze a prior sales contract (USPAP SR 1-5); misstated the applicable zoning; and failed to accurately describe the condition of the subject property (1-1,1-2).

Respondents' license as a real estate appraiser was revoked and she is ineligible to apply for a license of any rank for a minimum of ten (10) years on the basis that she aided and abetted the unlicensed practice of appraisal by utilizing unlicensed individuals and by facilitating the preparation of reports which bore the name of and Illinois licensed appraiser and the forged signature of that appraisal to complete appraisal reports for the purpose of obtaining mortgage loans. Violations: USPAP SR 1-1, 1-4, 1-5, 2-1 Respondent was suspended for one (1) year and fined $1,500 for preparing an appraisal in a careless and negligent manner, in that Respondent: failed to state within the body of the report that the subject property was located immediately next to elevated train tracks (USPAP SR 1-1); incorrectly stated that the subject property was vinyl sided when in reality it only had vinyl siding on the front and back of the property (USPAP SR 1-1, 2-1); neglected to mention the vacant, boarded up buildings located in the immediate vicinity (USPAP SR 1-1, 2-1), and utilized inappropriate Comps (USPAP SR 1-4), thereby rendering a misleading appraisal.

Violations: USPAP SR 1-1, 1-5, 2-1 and the Ethics Rule Respondent was suspended for sixty (60) days for rendering an appraisal in a careless or negligent manner (USPAP SR 1-1) in that respondent failed to report a prior sale of the subject property (USPAP SR 1-5), and misstated the condition of the subject property (USPAP SR 1-1, 1-2) and omitted certain information, thereby creating a misleading report.

Specifically, the respondent made a series of errors, in that he misstated the square footage of all Comparable Properties, failed to analyze/discuss consequences of the subject property being classified as a legal nonconforming use, failed to analyze sales history of subject property, and misstated the property values in the surrounding area, thereby rendering a misleading report.

The real estate appraiser license was reprimanded, fined $1,000 and required to complete a Non-Residential Report Writing class as a result of respondent having supervised an appraisal that was completed in a careless and negligent manner. The appraiser failed to establish the type of ownership of each Comparable (fee simple v. leasehold), failed to reconcile the difference between a chain restaurant and an independently owned restaurant, and failed to value the leaseholds of the Comparables.

For the second property, Respondent utilized inappropriate comparable properties in that they were located away from the external obsolescence of the active railroad yard, and failed to discuss what, if any adverse effect it would have on the value (USPAP SR 1-1, 2-1) thereby rendering a misleading report in violation of USPAP SR 2-1.
