Consent Order: Reprimand, $750 Fine and Education. Violation: SR 1 and 2, the Ethics Rules and the Record Keeping of the USPAP. Respondent failed to be aware of, understand and correctly employ those recognized methods and techniques that are necessary to produce a credible appraisal and failed to communicate each analysis, opinion and conclusion in a manner that is not misleading.

CHICAGO:

Gregory Eisin, 1998-00069 -- 10 14 1999

Consent Order: Restoration. Respondent filed a Petition for Restoration of his revoked Illinois Real Estate Appraiser's license, which was granted.

William W. Knecht, 1997-00064 -- 09 16 1999

Consent Order: Restoration of revoked Illinois Real Estate Appraiser's license, Reprimand, $1500 Fine. Respondent filed a Petition for Restoration of his revoked Illinois Real Estate Appraiser's license, which had been revoked by default order dated 07/28/99.

Orita J. Moore, 1999-00040 -- 12 06 1999

Consent Order: Revocation. Violation: SR 1 and 2 and the Ethics Provision of the USPAP. Respondent prepared an appraisal report misrepresenting the subject property in order to inflate the value. In addition, she failed to correctly complete research and analysis necessary to produce a credible appraisal and failed to communicate each analysis, opinion and conclusion in a manner that was not misleading.

Marshall Villarreal, 1995-01423 -- 10 19 1999

Consent Order: Reprimand, $500 Fine and Education. Violation: SR 2 of the USPAP. Respondent failed to disclose his contributions to an appraisal report prepared by another appraiser.

DARIEN:

Edward E. Lang, 1997-00066 -- 03 31 1999

Consent Order: Reprimand Violation: Ethics Provision (Conduct Section) of the USPAP. Respondent failed to complete an appraisal assignment after collecting a fee to develop and report the appraisal.

EDWARDSVILLE:

Donald G. Petroff, 1995-07481 -- 07 28 1999

Order: Revoked. Violation: Ethics Provision of the USPAP. Respondent accepted $150 payment to develop an appraisal report and neither did the appraisal nor returned the money. A circuit court judgement was entered against Respondent for $150 but was never satisfied.

ELMWOOD PARK:

Monika M. Brozek, 1996-00132 -- 03 15 1999

Consent Order: Reprimand; $1,000 Fine. Violation: Ethics Provision (Conduct Section) and Standards Rules 1 and 2 of the USPAP. Respondent acted as an advocate for her client by appraising the property higher than market value; by failing to be aware of, understand, and correctly employ those recognized methods and techniques that are necessary to produce a credible appraisal, specifically, by failing to collect, verify, analyze, and reconcile such comparable sales data, adequately identified and described, as are available to indicate a value conclusion; and, failing to communicate each analysis, opinion, and conclusion in a manner that is not misleading.

HANNA CITY:

Jody D. Kimbrell, 1996-00099 & 1997-00070 -- 03 31 1999

Order: Revocation, without consideration for restoration for a period of three years; license cannot be restored unless all required courses for the State License Real Estate Appraiser rank are retaken; passes examination for state licensure; and, submits 1,000 hours appraisal experience accrued after effective date of Order. Violation: Ethics Provision (Conduct Section), Departure Provision, Competency Provision and Standards Rules 1 and 2 of the USPAP. By random audit of Respondent's EXP-154 form, appraisal reports revealed experience that was not legally sufficient to renew her license by failing to include a signed certification in appraisal reports; failing to properly label reports; failing to define the value to be estimated; failing to cooperate with the Agency with the audit investigation; failing to communicate each analysis, opinion, and conclusion in a manner that was not misleading; failing to disclose interest in subject property as the listing salesbroker; performing appraisal service in a careless and neglectful manner; failing to understand and apply recognized appraisal methods and techniques; failing to properly identify the appraisal and appraisal report; and, failing to properly analyze and consider the current and immediate past sale listings relative to the subject property.

JACKSONVILLE:

Richard L. Samples, 1999-00125 -- 01 06 1999

Order: Probation; $4,000 Fine; not to exceed 18 months. Violations: SR 1 of the USPAP. Education; Log Audit. Respondent failed to understand and properly apply recognized appraisal techniques; committed substantial errors of omission by ignoring sales data that was more meaningful to the appraisal assignment than the sales data utilized in the report; failed to process an income approach; rendered the appraisal service in a careless and negligent manner by making errors that affected the final value estimate and resulted in a misleading appraisal report; failed to collect, verify and properly analyze data pertinent to the market value of the subject property; and, failed to process approaches to value and failed to justify the elimination of the approach that would have proven meaningful to the final value estimate.

MOUNT PROSPECT:

Valerie Roppolo-Nudo, 1999-00104 -- 10 19 1999

Consent Order: Reprimand; $500 Fine; commercial and/or industrial appraisal reports, specifically properties requiring an absorption analysis, to be reviewed by a Certified General Real Estate Appraiser; Education. Violations: SR 1 and 2 of the USPAP. Respondent failed to be aware of, understand and correctly employ those recognized methods and techniques that are necessary to produce a credible appraisal and failed to communicate each analysis, opinion and conclusion in a manner that is not misleading.

NAPERVILLE:

Nitin Bhatt, 1998-123; 1998-122; 1998-121; 1998-83; & 1998-130 -- 01 07 1999

Consent Order: Revocation; $1,500 Fine Violations: Ethics Provision (Conduct Section) and SR 1 and 2 of USPAP. Respondent acted as an advocate for his clients; rendered appraisal serve in a careless and/or negligent manner, which resulted in misleading appraisal reports; and, engaged in an unethical manner.  

ORLAND PARK:

Timothy Grossi, 1996-00096; 1997-00005 -- 09 21 1999

Consent Order: Reprimand; $2,500 Fine and Education, must obtain the review, approval and signature of a General Certified Appraiser for any appraisal reports of mixed use or commercial use properties. Violations: SR 1 & 2 of USPAP. Respondent provided an appraisal report on a mixed used property that was misleading. In addition, Respondent provided an appraisal report on a residential property that was misleading with regard to comparable sale properties.

OTTAWA:

William H. Houlihan, 1996-113; 1998-149; & 1998-150 -- 04 09 1999

Consent Order: Reprimand; $1,500 Fine; Education. Violations: SR 1 & 2 of USPAP. Failed to employ recognized methods and techniques necessary to produce a credible appraisal; and, failed to communicate in a manner that was not misleading.

PALOS PARK:

Thomas G. Costello, 1996-126 -- 04 09 1999

Consent Order: Reprimand; $500 Fine. Violation: SR 101-(b) of USPAP. Committed substantial errors of omission or commission that significantly affected appraisal report.

PEORIA:

Sheree S. Selvey, 1998-03 & 1998-08 -- 04 09 1999

Consent Order: Reprimand; $500 Fine; Uprank license within 1 year. Violations: SR 1 & 2 of USPAP. Failed to employ recognized methods and techniques; and, failed to communicate each analysis, opinion and conclusion in manner not misleading.

SUBLETTE:

John F. Hammond, III, 1996-00089 -- 03 15 1999

Consent Order: Revocation. Violation: Standards 1 and 2 of the USPAP. Respondent did not develop and report appraisals that demonstrated experience sufficient to pass the State License (154) experience audit and warrant renewal of his real estate appraisal license.

WHEATON:

Roger M. Potokar, 1997-00011 -- 03 15 1999

Consent Order: Reprimand; $500 Fine. Violation: Ethics Provision (Conduct Section) of the USPAP. Respondent advertised for or solicited appraisal assignments in a manner that was false, misleading, or exaggerated.

MICHIGAN CITY, IN:

Robert C. Barrett, 1997-00095 -- 07 28 1999

Order: Revocation. Violation: 5 ILCS 100/10-65. Respondent signed court documents in California stipulating that he was in arrears on child support payments and then failed to appear at status hearings and was held in default.

DALLAS, TX:

Ken P. Wilson, 1995-009815 -- 04 09 1999

Consent Order: Reprimand, $3,000 Fine. Violations: SR 1 and 2 of the USPAP. Respondent applied an inappropriate capitalization rate, which resulted in a misleading appraisal report.
