Home Inspector Disciplines - 2006

The following are summaries of recent disciplines regarding home inspector licenses. These are only summaries of the disciplines. For brevity, the summaries may not include all of the facts upon which a discipline was based, or all of the specific conditions of discipline. Accordingly, these summaries should not be relied upon as a comprehensive statement of the discipline in a given case, nor should they be exclusively relied upon as precedent as to how similar cases may be handled.

NOTE: Disciplines regarding home inspector licenses include. (1) reprimand (2) probation for a period with various possible conditions, (3) suspension for a period (this kind of suspension allows for restoration of the license at the end of the suspension period without the requirement that the licensee file a Petition for Restoration), (4) indefinite suspension for a period (this kind of suspension requires that the licensee file a Petition for Restoration, no earlier than at the end of the indefinite suspension period, to gain restoration of the license), (5) revocation, (6) termination, (7) refusal to renew a license, and (8) in the case of applicants, refusal to issue a license. The Division may also assess a fine not to exceed $10,000 per licensee as a result of a Formal Hearing.

Bolingbrook:

Leroy Cameron April 7, 2006
The home inspector license was reprimanded for failure to obtain a proper home inspection license; licensee failed to maintain adequate records and reports.

Carpentersville:

Gary Fasetti February 1, 2006
Gary Fasetti was assessed a $10, 000 civil penalty for holding himself individually as well as Real Estate Inspections and Real Estate Residential Inspections, Inc out as home inspectors in 2003, 2004 and again in 2005, despite having been issued letters to cease and desist from that conduct.

Des Plaines:

Michael R. Raffe October 4, 2006
The home inspector license was reprimanded for failure to timely complete statutorily required continuing education courses.

Palos Park:

Sean O'Leary October 4, 2006
The application for a home inspector license was granted subject to Probation based upon a disclosure of a felony conviction. The Probation period shall run concurrent with the completion of a criminal sentence of probation.

Roscoe:

Wayne Herzog August 17, 2006
The home inspector license was reprimanded based upon allegations that Mr. Herzog failed to produce an Inspection Report to the Division in a timely manner and failed to register an assumed business name.

Woodland Hills, CA:

Joseph Schinasi November 16, 2006
The home inspector license was cancelled as of November 16, 2006 and refused renewal for failure to complete statutorily required continuing education.

Ellicott City, MD:

John Howard October 4, 2006
The home inspector license was revoked for a minimum of 2 years for failure to complete statutorily required continuing education.
