Tomas Sasco was also assessed a fine of $5,000. The real estate broker corporation license of Nadia Ltd. aka ReMax Casablanca was placed on probation for a period of three (3) years, with the condition that it not act as an Escrow Agent during the three (3) year probation period. The corporation was also assessed a fine of $5,000. The disciplines were based upon evidence that Tomas Sasco, in his role as managing broker of record for the main office of ReMax Casablanca, failed to ensure a timely deposit of a check into an escrow account, failed to notify all principals about the delay regarding the deposit, and then failed to ensure a timely disbursement of the money from the escrow account. In another transaction, Tomas Sasco failed to ensure a timely deposit and timely disbursement of an earnest money check into/from an escrow account. Finally, Tomas Sasco failed to comply in a timely manner with the terms of a consent order dated May 22, 2003.

The real estate broker license was reprimanded, a $500 fine was assessed, and the respondent was required to successfully complete the Broker Administration course within 90 days, for releasing earnest money without written authorization from the parties to a real estate contract.

Anderson was reprimanded, a $1,900 fine was assessed, and extra education was required; the real estate broker license of David Hetzler was reprimanded, a $400 fine was assessed, and extra education was required; and Lincolnway Management, Inc. was assessed a $2,200 fine and agreed to obtain a real estate broker corporation license which will be issued subject to a reprimand. These disciplinary terms were based, in part, upon evidence that Lincolnway Management, Inc. practiced real estate for at least 22 months without a license.
