As a condition to her probation, respondent was required to submit bi-monthly reports detailing the transactions of her sponsored licensee and her company, Vilnius Realty; successfully complete two (2) 15-hour pre-license broker courses; and notify the Office of Banks and Real Estate (OBRE) within 15 days of when she sponsors any other licensees and include such licensees in her bi-monthly reports to OBRE.

Mr. Carrera was ordered to pay a fine of $5,000, and he was prohibited from any ownership of any sponsoring broker business and prohibited from acting in any management capacity for any sponsoring broker business. Furthermore the real estate broker corporation license of First American Realty & Mortgage, Inc. was revoked, and it was ordered to pay a fine of $5,000. The disciplines were based upon allegations set forth in an eight count formal complaint, to wit, respondent Carrera engaged in the practice of real estate after his license expired, that respondent First American Realty & Mortgage, Inc., engaged in the practice of real estate with a managing broker who did not have an active license, that respondent Carrera acted as a dual agent in a transaction but failed to obtain the required dual agency consent forms, that respondent Carrera acted in his own self interest in a real estate transaction (by seeking to purchase the real estate) rather than acting in the best interest of his seller-client, that respondent Carrera acted as a dual agent in another real estate transaction in which he also contracted to purchase the real estate, that respondent Carrera aided and abetted the unlicensed practice of real estate by First American Realty & Mortgage, Inc., and that respondents Carrera and First American Realty & Mortgage, Inc. failed to produce documents requested by IDFPR.

The real estate broker license was indefinitely suspended for a minimum period of seven years for having pleaded guilty in a federal court to felony mail fraud. Per the guilty plea, Mr. Agama admitted that, between 1998 and 2001, he was involved in a scheme to defraud HUD, which included falsification of documents in loan applications.
